Procedure for obtaining a Power of Attorney for Turkey from a Turkish Notary or Turkish Consulate
The power of attorney is an official document by which one person authorises another to carry out certain actions on their behalf and at their expense. Powers of attorney used for legal or official matters must be notarised to be legally valid. Such documents set out clearly and unambiguously the powers of the authorised person. For example, a power of attorney can be used to buy and sell property in Turkey, to withdraw cash from Turkish banks or to deal with legal and official matters in Turkey.
Documents and Information Required for a Power of Attorney Issued by a Turkish Notary or Consulate and Valid in Turkey:
1. Power of Attorney template (prepared by us at your request)
2. Copy of passport and Turkish ID number (of the principal and the authorised representative)
3. Addresses of the principal and authorised representative
If applicable (depending on the situation):
1. Land register extract, divorce decree, civil register extract, if available
2. Other documents (old identity documents, certificates of change of name, etc.)
3. For example, in land registry matters such as the purchase/sale of real estate, transfer of property, construction contracts, donations, car sales, real estate pre-emption contracts and divorce proceedings, the power of attorney must include a passport photograph.
Procedure for obtaining a power of attorney for Turkey from a notary abroad
If the power of attorney is issued by a notary abroad, it must be both certified and translated into Turkish. In order for the power of attorney to be valid in Turkey, it must also be provided with an apostille, which must be issued by the relevant authorities in the issuing country.
For this purpose, we will provide you with a template tailored to your requirements, which we will send to you in electronic form and translated. This template can then be signed by a notary of your choice. Once the signature on the power of attorney has been authenticated, the document must be submitted to the relevant district court for an apostille to be affixed. Only when this official endorsement has been affixed will the power of attorney be legally recognised in Turkey and can be used there without any problems.
Documents and information required for a power of attorney issued by a foreign notary to be valid in Turkey:
1. Power of Attorney template (will be prepared by us at your request)
2. The Power of Attorney template must be translated into both languages (we can also do this for you).
3. Copy of passport and Turkish passport number (of the principal and the authorised representative)
4. Addresses of the principal and the authorised representative
5. The power of attorney must be apostilled.
